1. Acceptance of These Terms
By accessing Machav, creating an account, placing an order or otherwise using our services, you agree to these Terms & Conditions.
These Terms should be read together with our:
- Terms of Service;
- Privacy Policy;
- Cookie Policy;
- Returns & Refunds Policy;
- Shipping & Delivery Policy; and
- Grievance, Complaints & Redressal Policy.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded or limited.
2. About Machav
Machav operates an online ecommerce business offering products to customers in New Zealand and, where available, other countries.
Machav may source products through manufacturers, wholesalers, distributors and other suppliers and may use third-party fulfilment and logistics providers.
Some products may therefore be shipped directly from a supplier or fulfilment location.
Important supplier responsibility clarification
The involvement of a third-party supplier, manufacturer, fulfilment provider or logistics provider does not transfer Machav's customer-facing responsibilities to the customer.
Where Machav is the seller of a product, Machav remains responsible for its obligations to the customer under these Terms and applicable law, including mandatory consumer rights and remedies.
Customers should contact Machav regarding product defects, incorrect products, damaged products, returns, refunds, delivery problems or other order issues.
Machav may deal with the relevant supplier or fulfilment provider separately to investigate and resolve the issue.
3. Product Information
We make reasonable efforts to ensure that product descriptions, specifications, photographs, prices and availability are accurate.
Product images may vary slightly because of screen settings, manufacturing changes or supplier updates.
Machav will not knowingly make misleading or deceptive representations about products.
4. Prices
Prices are displayed in the currency shown on the website or checkout.
Applicable shipping charges, taxes, customs duties or other charges may apply depending on the order and destination.
Machav may correct genuine pricing or listing errors.
Where a material pricing error occurs, Machav may contact you before fulfilment to confirm whether you wish to proceed.
5. Orders
Submitting an order constitutes an offer to purchase.
An order becomes accepted when Machav confirms acceptance or begins fulfilment, subject to applicable law.
Machav may decline or cancel an order where:
- the product is unavailable;
- there is a genuine pricing or listing error;
- payment cannot be verified;
- fraud or misuse is reasonably suspected;
- delivery is unavailable;
- the transaction would breach applicable law; or
- circumstances outside Machav's reasonable control prevent fulfilment.
If Machav cancels an accepted order after payment has been received, the amount paid for the cancelled order will be refunded, subject to applicable law.
6. Payment
Payments may be processed by third-party payment providers.
Machav generally does not store complete payment-card details where those details are processed directly by a payment provider.
You must provide accurate billing and payment information and be authorised to use the selected payment method.
7. Dropshipping and Third-Party Fulfilment
Machav may use third-party suppliers and fulfilment providers.
As a result:
- products may ship directly from suppliers;
- products may originate from different countries;
- different products may have different delivery estimates;
- one order may arrive in multiple packages;
- packages may have different tracking numbers;
- supplier or manufacturer packaging may be used.
These operational arrangements do not change the customer's contractual relationship with Machav where Machav is the seller.
Machav may seek reimbursement, replacement, indemnification or other remedies from its suppliers separately where appropriate.
Any agreement between Machav and a supplier does not reduce or exclude a customer's rights against Machav.
8. Delivery
Delivery is governed by our Shipping & Delivery Policy.
Estimated delivery times are estimates unless Machav expressly agrees to a guaranteed delivery date.
Where Machav sells a product to a New Zealand consumer and arranges delivery, Machav remains responsible for its applicable delivery obligations.
9. Consumer Guarantees Act
Where the Consumer Guarantees Act 1993 applies, nothing in these Terms excludes, restricts or modifies rights that cannot legally be excluded.
Applicable guarantees may include requirements concerning:
- acceptable quality;
- fitness for purpose;
- correspondence with description;
- safety; and
- delivery.
Depending on the circumstances, available remedies may include repair, replacement, refund or other remedies provided by law.
10. Returns and Refunds
Returns and refunds are governed by our Returns & Refunds Policy.
Any voluntary change-of-mind return policy is separate from statutory consumer rights.
Machav will not use a return deadline or other policy condition to unlawfully restrict statutory rights.
11. Product Safety
Machav expects products supplied through its supply chain to comply with applicable safety and legal requirements.
If you believe a product is unsafe, stop using it where appropriate and contact Machav immediately.
Machav may investigate the product, suspend sales, contact affected customers, coordinate with suppliers or take other appropriate action.
12. Promotions
Promotional offers are subject to the terms displayed with the relevant promotion.
Machav will not knowingly make false or misleading promotional representations.
13. Intellectual Property
Machav's name, branding, website design, software, text, graphics, photographs and other content are owned by or licensed to eComCloud Limited unless otherwise stated.
You must not reproduce, distribute, modify, scrape or commercially exploit Machav content without permission, except where permitted by law.
14. Prohibited Activities
You must not:

- payments;
- hosting;

- other business functions.
Third parties may have their own terms and privacy policies.
16. Website Availability
Machav aims to maintain reliable website availability but does not guarantee uninterrupted or error-free operation.
We may temporarily suspend or modify services for maintenance, security, upgrades or operational reasons.
17. Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Subject to applicable law, Machav is not responsible for indirect or consequential losses that are not reasonably foreseeable or legally recoverable.
This clause does not limit mandatory consumer rights.
18. Force Majeure
Machav is not responsible for delays caused by circumstances reasonably outside its control, including natural disasters, war, industrial disputes, severe weather, government restrictions, major transport disruption, widespread technology failures or other force majeure events.
This does not automatically remove statutory consumer rights.
19. Privacy
Personal information is handled in accordance with our Privacy Policy and applicable privacy law.
20. Complaints
Complaints should be submitted to:
See our Grievance, Complaints & Redressal Policy for further information.
21. Changes
Machav may update these Terms from time to time.
The latest version will be published on the website.
Changes will not retrospectively remove rights that have already accrued.
22. Governing Law
These Terms are governed by New Zealand law, subject to mandatory laws that may apply to consumers in other jurisdictions.
